I, the undersigned, also known as Private Property Owner, am a landowner and beneficial water usage owner in ____________and __________.
My respective properties, also known as Said Areas, are located in the County of ______in _____________, and the Counties of _______________in____________.
It has been brought to my attention that The Center for Biological Diversity, its non-profit and for-profit affiliate organizations, and/or the representatives, has allegedly included Said Areas in plans for proposed uses of Said Areas, through voiced intentions, public media, prospectuses and certain other papers.
So that there is no misunderstanding, I want to make it clear that neither you nor any of your affiliates have ever received Private Property Owner’s permission to include Said Area in your rendering. By including Said Area in your plans, you have placed a cloud on Said Area and clearly violated Owner’s private property rights in Said Area.
As a Private Property Owner whose property is now negatively impacted by your plans for Said Area and/or nearby areas, I am providing this letter to serve as a formal demand that you remove, erase and delete any and all references to Said Area from any and all materials generated by, or utilized by, The Center For Biological Diversity or its affiliates or representatives, within 5 days of receipt of this letter.

Furthermore, let it be known that I the undersigned am not associated in any manner whatsoever with an organization known as The Center For Biological Diversity, nor am I associated in any manner whatsoever with representatives, associates or family members of said organization, and that the undersigned did not give any permission whatsoever to any party, including The Center For Biological Diversity et al., near and/or on the Said Area properties of the undersigned.
Because the undersigned has no association with said organization and has no knowledge of said organization’s specific plans or intentions, the undersigned is to be held harmless and totally exempt from any liabilities whatsoever that may result from any representation whatsoever that said organization or its allied organizations may make to any persons as pertains to Said Area and said organization’s plans.
In keeping with my State and Federal Constitutional rights to acquire, possess and protect my private property, I hereby demand that you file a certified letter with the clerk and assessor each afore-mentioned County, clearly affirming that you have removed any and all references to my property from any and all plans you may have now or in the future.
Should you choose not to comply with my demand, I will exercise my right to seek remedy via liens, seizures or other legal actions, as may be appropriate and provided by law. Should your non-compliance result in this Private Property Owner having to take action to remove your physical property from Said Area or pursue legal action, you will be charged any and all associated costs – including legal fees, court costs, accrued administrative fees, gasoline, and labor costs at the rate of $55.00 per hour.

As Private Property Owner of Said Area, I expect receipt of documentation within six (6) business days following receipt of this Demand Notice, confirming that The Center for Biological Diversity has received said Notice. I further expect confirmation within sixty (60) days that the Project and its allied organizations have met all terms of this Notice.
