Progressives Plan New Lawsuit to Declare Feral Horses in Wyoming ‘Wild Animals’ Under Federal Endangered Species Act

The progressive group Friends of Animals (FOA) is planning a lawsuit to have the feral horses and burros roaming Wyoming declared an “endangered species” by the federal government under the federal Endangered Species Act (7 U.S.C. § 136, 16 U.S.C. § 1531 et seq) by 2015.

Mike Harris, an attorney for FOA, based in its regional office in Denver tells LandAndWaterUSA that the militants, under the provisions of the ESA, will file the lawsuit within 12 months or so from this week. Click here to continue.

U.S. Appeals Court rules against friends of feral horses, but BLM still failing to contain problem

A federal appeals court has denied a radical activist group’s request to halt the feral horse roundup in Wyoming by the Bureau of Land Management (BLM). But the BLM is not out of the woods of controversy yet – as opponents have engaged in civil disobedience to stall the roundup. What is more, others note the agency is not properly following the advice from a federal scientific panel, whose members are appointed by the National Academy of Sciences, to contain the environmental damage caused by the hybrid horses in the American West. The controversy over Smart Meters has been steaming in various counties in the United States, including the County of Larimer and the area served in Colorado’s Poudre Valley Rural Electric Association where Lt. Col. Tom Niichel lives with his wife and children. He is on active duty with the United States Air Force. Whose Water Is It? Liberal Attorney Claims ‘The State’ Owns All South Platte River Water. Colorado Governor's Office Points Out That’s Not The Law. By Gene Koprowski

A leading liberal Colorado water rights attorney is claiming that “the state” government owns all of the South Platte River’s water. But the water czar for the state’s Democratic Gov. John Hickenlooper is pointing out that that opinion is not the law, and is citing references to statutes, and case law, that inform his stance in correspondence with Land And Water USA.

During a meeting of the South Platte Basin Round Table meeting last week, noted left-leaning attorney, Michael D. Shimmin, a partner in the Boulder-based firm Vranesh and Raisch, LLP, was responding to a question by rancher Chuck Sylvester. Sylvester asked the open forum exactly who was the beneficial owner of the water, when the river level was high, or when it was low. In response, Shimmin excitedly exclaimed, “the state.”

The counselor did not elaborate, but observers said there was a stunned silence in the room after the on-the-record comment, made during the public forum. Shimmin lists the South Platte Basin Round Table and the Colorado Interbasin Compact Committee among his “professional affiliations” on his official biography. The South Platte Basin Roundtable lists Shimmin as an “at large” member.

Shimmin did not respond to an e-mail asking him to elaborate on the opinion by a Land and Water USA reporter.

Now that I have finished the work that piled up during my time in Washington, D.C., including fundraising efforts for 2013, I want to report to you on the arguments. Click here to continue.

Tuesday, January 14, at 11:00 EDT, MSLF Vice President and Chief Legal Officer, Steven J. Lechner, will step before the podium in the Courtroom of the Supreme Court of the United States, face the nine justices, and open with, “Mr. Chief Justice and may it please the Court.” Thus will begin the culmination of MSLF’s long battle, which began in 2006, in defense of a Wyoming man’s right not to have his private property seized by the federal government for a high-altitude trail. This is not just about MSLF’s client, Marvin Brandt; thousands of landowners across the country will be affected by the ruling of the Supreme Court, which will come later this year. In the Brandt case the United States is asking the Supreme Court to reverse a ruling the Court made in 1942, a ruling that the United States urged upon the Court! In that 1942 ruling, the Court held that railroad rights-of-way granted under an 1875 law are easements to which the United States keeps no rights. The United States no longer likes that 1942 ruling because it keeps federal agencies from seizing the private property of people like MSLF’s client, Marvin Brandt.
